Rules for using DietWings

These Terms of Service govern your access to and use of DietWings, including the public website, landing pages, legal pages, changelog, account features, meal-planning tools, AI-assisted features, AI Nutritionist chat, grocery lists, pantry and inventory tools, leftovers features, adherence and feedback tools, PDF exports, notifications, billing features, support features, administrative systems, and related services.

By creating an account, accessing DietWings, clicking to accept, starting a trial, purchasing a subscription, purchasing token packages, using AI-assisted features, connecting a third-party account, or otherwise using the service, you agree to these Terms.

If you do not agree to these Terms, do not access or use DietWings.

These Terms should be read together with our Privacy Policy, Cookie Policy, Medical Disclaimer, Data Processing page, and any plan, checkout, invoice, enterprise agreement, data processing agreement, or written addendum that expressly applies to your use of DietWings.

DietWings is provided by Isentró Kft, registered at 1082 Budapest, Corvin sétány 6, 8th floor, unit 4, Hungary. In these Terms, “DietWings”, “we”, “us”, and “our” refer to that entity and, where applicable, its affiliates, officers, directors, employees, contractors, service providers, licensors, and agents.

If you use DietWings on behalf of a company, organization, household, client, employer, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, “you” includes both you personally and the entity you represent.

If a separate signed agreement between you and DietWings conflicts with these Terms, that signed agreement controls only for the subject matter it expressly covers.

DietWings provides informational and organizational tools for meal planning, grocery organization, recipe suggestions, pantry and leftovers organization, nutrition estimates, household planning, adherence tracking, workout tracking, AI-assisted plan changes, PDF exports, account management, notifications, subscriptions, token usage, support, and related product operations.

DietWings may generate, revise, summarize, format, display, export, or organize meal plans, recipes, ingredients, portions, preparation steps, shopping lists, pantry suggestions, cautions, warnings, revisions, AI chat responses, diffs, and other outputs based on information you provide and available product logic.

DietWings is not a healthcare provider, dietitian service, nutrition clinic, medical device, emergency service, pharmacy, electronic health record, clinical decision-support system, or substitute for professional judgment.

• You must be able to enter into a legally binding agreement.
• You must use DietWings lawfully in your location.
• You must not use DietWings if you are barred from using the service under applicable law, sanctions rules, export-control rules, payment-provider rules, or DietWings policies.
• DietWings is not intended for children who cannot lawfully use online services or consent to data processing in their location.
• If you are under the age of majority in your location, you may use DietWings only with involvement and permission of a parent or legal guardian, unless local law prohibits such use.
• A parent, guardian, household organizer, or authorized adult is responsible for any information entered about a child, teen, guest, household participant, client, employee, or other third party.

You may need an account to use certain DietWings features. You agree to provide accurate, current, and complete account information and to keep it updated.

You are responsible for safeguarding your password, email account, OTP/2FA device, backup codes, trusted devices, connected Google account, connected Telegram account, payment accounts, exported files, and all activity under your account.

You must notify DietWings promptly if you suspect unauthorized access, credential compromise, account takeover, payment misuse, token misuse, or unauthorized shared access.

DietWings may require email verification, password reset, OTP/2FA, backup codes, trusted-device checks, login notifications, additional verification, or other security steps before allowing access to certain features.

DietWings may refuse, suspend, restrict, or terminate access if we reasonably believe an account is inaccurate, compromised, abusive, unlawful, fraudulent, risky, or used in violation of these Terms.

DietWings may allow you to add household members, temporary guests, shared users, or other participants to a meal plan or account workflow.

If you enter information about another person, you represent that you have the right, authority, permission, and legal basis to provide that information and to use it in DietWings.

You are responsible for assigning appropriate permissions, reviewing shared access, removing access when it is no longer needed, and avoiding disclosure of information to people who should not see it.

Shared users may be able to view, edit, export, delete, restore, generate, regenerate, or otherwise interact with meal plans, shopping lists, pantry items, AI chat, billing-related information, or other account data depending on the permissions and features enabled.

DietWings is not responsible for disputes between household members, shared users, guests, account owners, administrators, clients, employees, or other people who are given access by you or through your account.

DietWings outputs depend on the information you provide. Incorrect, incomplete, outdated, exaggerated, omitted, or misleading inputs may produce unsuitable, inaccurate, unsafe, or unusable outputs.

You are responsible for entering accurate information, keeping it updated, removing information that should no longer be used, and confirming that restrictions, allergies, medical flags, goals, preferences, budgets, cooking schedules, pantry items, household members, guest days, and shared-access settings are correct.

You should submit only information that is necessary, lawful, accurate, and appropriate for meal-planning use.

Do not submit information about another person unless you are authorized to do so.

Do not submit unnecessary medical records, diagnoses, prescriptions, lab results, genetic information, government identifiers, financial credentials, private wallet keys, payment credentials, or other sensitive information that is not needed for your use of DietWings.

DietWings may use AI systems and automated processing to generate meal plans, recipes, shopping lists, pantry suggestions, cautions, warnings, summaries, plan revisions, diffs, PDF content, and AI chat responses.

AI output may be incomplete, inaccurate, outdated, repetitive, inconsistent, unsafe, unsuitable for a particular person, or based on misunderstood inputs.

DietWings does not guarantee that AI output will be unique, error-free, nutritionally complete, medically appropriate, allergen-free, affordable, locally available, culturally appropriate, compatible with your equipment, compatible with your schedule, or suitable for every household member.

You are responsible for reviewing all generated meal plans, recipes, ingredients, portions, preparation steps, cooking instructions, grocery items, substitutions, pantry suggestions, warnings, cautions, shopping-list updates, plan diffs, and AI chat responses before relying on them.

You should not rely on DietWings for emergency decisions, medical decisions, allergy-safety decisions, medication decisions, pregnancy nutrition, eating-disorder recovery, child nutrition, clinical diets, or any decision requiring professional judgment.

DietWings is a planning and organization tool. It does not provide medical advice, diagnosis, treatment, cure, mitigation, monitoring, prevention, professional nutrition therapy, medical clearance, medication advice, or clinical meal prescriptions.

If you have allergies, intolerances, medical conditions, are pregnant, breastfeeding, postpartum, trying to become pregnant, follow a clinical diet, take medications, have an eating-disorder history, plan nutrition for a child or teen, or are making major nutrition, calorie, macro, fasting, supplement, or weight-related changes, consult a qualified professional before relying on DietWings outputs.

Calories, macros, micronutrients, portions, serving sizes, grocery quantities, and budget estimates are estimates only. Actual values may vary by ingredient brand, serving size, preparation method, substitutions, product formulation, label accuracy, packaging, restaurant practices, regional availability, user edits, and measurement error.

The absence of a DietWings warning or caution does not mean that a meal, recipe, ingredient, grocery item, target, plan, or behavior is safe or appropriate.

DietWings cannot guarantee that any meal plan, recipe, ingredient list, grocery list, pantry suggestion, substitution, AI response, or generated caution is allergen-free, intolerance-safe, contamination-free, or suitable for a person with food allergies, sensitivities, celiac disease, or other food-related risks.

You must review ingredients, labels, substitutions, preparation steps, shared equipment, restaurant items, packaged foods, pantry items, expiration dates, and cross-contact risks before shopping, cooking, serving, or eating.

Ingredient names, product labels, formulations, allergen declarations, manufacturing practices, restaurant practices, and regional food laws may change. DietWings may not detect hidden allergens, trace allergens, cross-contact, mislabeled products, ambiguous ingredients, or local labeling differences.

You are responsible for safe shopping, storage, refrigeration, freezing, thawing, cooking temperatures, reheating, hygiene, equipment safety, expiration-date review, and suitability of ingredients.

DietWings may allow you to submit prompts, files, screenshots, meal-plan drafts, recipes, shopping lists, pantry data, feedback, bug reports, feature requests, AI chat messages, and other content.

You represent that you have all rights, permissions, consents, and legal bases needed to submit and use that content in DietWings.

You are responsible for reviewing files, screenshots, prompts, and support attachments before submitting them and for removing information that is unnecessary, confidential, unlawful, harmful, infringing, or not authorized for processing.

DietWings may reject, block, remove, quarantine, scan, limit, or delete content where we reasonably believe it may be unlawful, unsafe, abusive, malicious, infringing, excessive, technically harmful, outside product scope, or in violation of these Terms.

DietWings is not responsible for preserving user content as your sole backup. You should keep your own copies of important meal plans, PDFs, recipes, grocery lists, pantry records, invoices, or other data.

You retain any rights you have in content you submit to DietWings.

You grant DietWings a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, analyze, format, modify, display, transmit, translate, summarize, generate outputs from, create derivative works from, and otherwise use your content as reasonably necessary to provide, secure, support, maintain, improve, and administer DietWings.

This license includes the right to share content with service providers and sub-processors as needed for hosting, storage, AI functionality, authentication, payments, security, analytics, error monitoring, support, file handling, PDF generation, notifications, and other product operations.

This license continues for as long as reasonably necessary for the purposes described in these Terms and our Privacy Policy, including retention in backups, logs, audit records, security records, support records, billing records, legal records, or anonymized and aggregated data where permitted.

You waive, to the extent permitted by law, any moral rights or similar rights that would prevent DietWings from technically processing, formatting, modifying, summarizing, or displaying your content as needed to provide the service.

Subject to these Terms, your plan, and applicable law, as between you and DietWings, you may use meal plans, recipes, shopping lists, PDFs, AI chat responses, and other outputs generated for your account for your personal, household, internal business, or other lawful purposes permitted by your plan.

DietWings does not guarantee that outputs are protectable by intellectual property law, unique to you, confidential, non-infringing, commercially usable, medically suitable, nutritionally complete, or acceptable to any third party.

Other users may receive similar or identical outputs because AI systems, recipes, common ingredients, meal templates, dietary patterns, and product logic may produce overlapping results.

Your rights to outputs do not include ownership of DietWings software, models, prompts, templates, workflows, interfaces, algorithms, databases, designs, trademarks, product logic, know-how, or other DietWings intellectual property.

DietWings and its licensors own all rights, title, and interest in the service, including software, interfaces, designs, workflows, templates, prompts, product logic, databases, algorithms, documentation, analytics, trademarks, service marks, logos, and other intellectual property.

Subject to these Terms, DietWings grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the service for lawful purposes permitted by your account, plan, and these Terms.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, extract, scrape, train competing systems on, or create derivative services from DietWings except where these Terms or mandatory law expressly allow it.

No rights are granted except as expressly stated in these Terms.

If you submit feedback, ideas, suggestions, bug reports, feature requests, reviews, testimonials, or other comments, DietWings may use them without restriction or compensation, to the extent permitted by law.

If you submit a public review or testimonial, you represent that it is truthful and based on your genuine experience. DietWings may display, excerpt, edit for length or clarity, remove, or stop using reviews and testimonials where permitted by law and your applicable consent.

Do not submit confidential information, medical information, third-party personal information, trade secrets, or content you do not want DietWings to use for support, product improvement, or marketing where applicable.

• Use DietWings only for lawful purposes and in accordance with these Terms.
• Do not interfere with, disrupt, overload, damage, or compromise DietWings systems, providers, payment systems, AI systems, security controls, or other users.
• Do not attempt unauthorized access to accounts, admin systems, APIs, databases, prompts, models, logs, tokens, billing systems, or infrastructure.
• Do not scrape, crawl, harvest, copy, bulk export, or mine DietWings data or outputs except through supported product features and within reasonable use.
• Do not reverse engineer, decompile, bypass access controls, bypass rate limits, remove security protections, exploit bugs, or test vulnerabilities without written permission.
• Do not use bots, scripts, automation, prompt-injection attacks, credential stuffing, fake accounts, abusive trial cycling, payment abuse, token abuse, or other deceptive practices.
• Do not submit malware, malicious files, hidden instructions, phishing content, unlawful content, infringing content, defamatory content, abusive content, deceptive content, or content that violates another person’s rights.
• Do not use DietWings to harass, exploit, harm, profile, discriminate against, surveil, or make unlawful decisions about another person.
• Do not use DietWings in a way that violates food, health, medical, consumer, privacy, employment, advertising, payment, tax, sanctions, export-control, or other applicable laws.

DietWings is not designed for high-risk, regulated, emergency, clinical, or safety-critical use.

You must not use DietWings as a substitute for medical care, clinical nutrition therapy, emergency services, allergy-safety verification, medication advice, eating-disorder treatment, pediatric medical care, pregnancy care, hospital nutrition, institutional food safety, or any use where failure could reasonably lead to death, personal injury, serious health consequences, or unlawful discrimination.

You must not use DietWings to provide medical, dietetic, therapeutic, clinical, regulated healthcare, or professional nutrition services to third parties unless a separate written agreement expressly permits that use and you are solely responsible for all professional obligations, licenses, consents, reviews, and compliance requirements.

Unless DietWings has signed a separate written Business Associate Agreement that expressly says otherwise, you must not use DietWings to create, receive, maintain, or transmit protected health information on behalf of a HIPAA covered entity or business associate.

Authorized DietWings personnel, contractors, or administrators may access account, plan, billing, technical, security, support, and administrative data where reasonably necessary to operate the service, provide support, investigate bugs, prevent abuse, secure accounts, resolve billing issues, enforce policies, comply with law, or perform authorized administrative actions.

Administrative tools may include user search, user detail views, login-history review, token-usage review, role management, account blocking or unblocking, subscription grants, token adjustments, payment-provider management, promo-code management, content and changelog management, site-alert management, feedback management, audit logs, analytics dashboards, LLM usage monitoring, cost monitoring, and compliance-policy controls.

Where a protected support or administrative feature allows authorized personnel to access or act as a user, DietWings aims to limit such access to legitimate support, safety, security, compliance, troubleshooting, billing, or administrative purposes and to record relevant activity in audit logs where appropriate.

If you are given administrative access to DietWings, you must use it only for authorized purposes, keep all access credentials confidential, comply with internal policies and applicable law, and avoid accessing user data unless you have a legitimate need.

Some DietWings features may be free, trial-based, subscription-based, usage-based, token-based, or available only through a paid plan.

Pricing, trial terms, renewal terms, included features, limits, token rules, cancellation options, taxes, and payment details are shown at checkout, in the product, in your account, or in other applicable notices.

If your plan is described as automatically renewing, you authorize DietWings and its payment providers to charge the applicable payment method on a recurring basis until you cancel, unless mandatory law or the applicable checkout terms provide otherwise.

If a free or discounted trial converts into a paid subscription, the conversion terms, price, billing period, and cancellation deadline should be shown before you start the trial or provide payment information.

You are responsible for reviewing plan terms before purchase and for cancelling before renewal if you do not want future charges.

DietWings may use internal tokens, credits, usage units, or similar balances to measure access to AI generation, meal-plan creation, plan updates, retries, exports, or other usage-based features.

Tokens are not money, stored value, cryptocurrency, gift cards, bank deposits, securities, legal tender, or payment instruments. They have no cash value and are not redeemable for cash unless required by law.

Tokens may be included in a subscription, purchased as packages, granted manually, adjusted by administrators, awarded through promotions, or used to access specific features.

Token consumption rules may vary by feature, model, provider, plan, request size, retry, file upload, PDF export, regeneration, or AI chat usage. The product may display estimated or actual token usage, but estimates may differ from final usage.

DietWings may deduct tokens when a request is submitted, processed, generated, retried, revised, exported, or completed according to the applicable product rules.

Failed, stopped, abusive, fraudulent, excessive, or policy-violating requests may not qualify for token refunds. DietWings may provide retries, adjustments, or credits where the product rules, support review, or applicable law require it.

Tokens may expire, be limited, be non-transferable, be plan-specific, be region-specific, or be forfeited after account deletion, cancellation, chargeback, refund, fraud, abuse, or Terms violations, unless mandatory law provides otherwise.

DietWings may use payment providers such as Stripe, Cryptomus, or other supported providers to process subscriptions, trials, token packages, promo codes, invoices, refunds, taxes, payment authentication, fraud checks, and billing history.

Payment providers may process payment credentials, card information, wallet information, billing details, transaction identifiers, fraud signals, checkout data, tax metadata, and other payment information under their own terms and privacy policies.

DietWings does not intend to store full payment card numbers, bank passwords, private wallet keys, or payment-provider account passwords in DietWings systems.

You agree to provide accurate billing information and authorize DietWings and its payment providers to charge applicable fees, taxes, and other amounts due under your plan or purchase.

DietWings may suspend, restrict, downgrade, or terminate access for failed payments, unpaid invoices, payment disputes, chargebacks, suspected fraud, payment-provider restrictions, or billing abuse.

If DietWings allows crypto-related payments through Cryptomus or another provider, the payment may involve blockchain confirmations, wallet addresses, transaction hashes, network fees, exchange rates, volatility, provider review, anti-fraud checks, and compliance checks.

Crypto transactions may be irreversible, delayed, underpaid, overpaid, sent to the wrong address, affected by network congestion, affected by exchange-rate changes, or rejected by a payment provider.

DietWings is not responsible for loss caused by incorrect wallet addresses, unsupported assets, wrong networks, failed confirmations, network fees, exchange-rate changes, wallet compromise, blockchain delays, third-party provider decisions, or actions outside DietWings systems.

Any crypto-related refund, if available, may be processed according to payment-provider rules, applicable law, the amount actually received or settled, exchange-rate calculations, network fees, and compliance restrictions.

Fees may be exclusive of taxes unless stated otherwise. You are responsible for applicable taxes, duties, levies, exchange fees, payment-provider fees, bank fees, blockchain network fees, or similar charges, except where DietWings is required to collect or remit them.

You may cancel a subscription through the available product settings, billing portal, payment-provider flow, or support channel described for your plan.

Cancellation usually stops future renewals but does not automatically refund past charges, unused subscription time, consumed tokens, purchased token packages, setup work, or completed usage, unless the checkout terms, product rules, support decision, or applicable law require otherwise.

Where consumer law gives you withdrawal, refund, cooling-off, cancellation, or renewal rights, those rights apply despite anything in these Terms that would otherwise conflict.

If you purchase immediate access to digital features, AI generation, token packages, downloadable content, or other digital services, you may be asked to consent to immediate performance and acknowledge any effect this may have on statutory withdrawal rights where applicable law allows.

If you believe a charge is incorrect, contact support before filing a chargeback where reasonably possible. DietWings may investigate disputed charges and may restrict access during unresolved payment disputes, suspected fraud, or chargeback abuse.

DietWings may offer promo codes, discounts, credits, grants, trials, or promotional tokens at its discretion.

Promo codes may be limited by account, region, plan, time period, payment method, eligibility, usage count, or other conditions shown at the time of offer.

Promo codes have no cash value, may not be resold, may not be combined unless stated, and may be modified, disabled, refused, or revoked where DietWings reasonably believes there is misuse, fraud, error, ineligibility, abuse, or violation of the offer terms.

A discount or promotional benefit does not guarantee future pricing, future eligibility, renewal discounts, or continued availability of the same offer.

DietWings may add, modify, limit, suspend, replace, or discontinue features, plans, token rules, AI models, providers, pricing, quotas, limits, currencies, payment methods, promo codes, or product workflows as the service evolves.

Material pricing changes for active paid subscriptions will be handled according to the notice, renewal, cancellation, and consumer-right requirements that apply to your plan and location.

If you do not agree with a future price change or plan change, your remedy is to cancel before the change applies, unless mandatory law provides another remedy.

DietWings does not guarantee that any feature, AI model, provider, integration, export format, admin tool, payment method, notification channel, country setting, language, currency, or unit system will remain available indefinitely.

DietWings is provided on an “as available” basis. The service may be interrupted, delayed, degraded, unavailable, inaccurate, or limited because of maintenance, updates, bugs, provider outages, network issues, payment-provider issues, AI-provider issues, security incidents, abuse prevention, legal restrictions, or events outside DietWings’ control.

DietWings may impose usage limits, rate limits, file limits, token limits, export limits, storage limits, device limits, shared-access limits, plan limits, or admin limits to protect the service and operate it fairly.

Beta, experimental, preview, or early-access features may be less reliable, may change without notice, may produce incorrect outputs, may have limited support, and may be discontinued at any time.

DietWings does not guarantee uninterrupted service, error-free operation, perfect backups, permanent data availability, or that every bug, failed generation, payment issue, or provider issue will be resolved.

DietWings may link to or integrate with third-party services, including Google, Telegram, Stripe, Cryptomus, AI providers, hosting providers, analytics tools, error monitoring tools, email providers, support tools, PDF tools, food data sources, and other providers.

Third-party services may have their own terms, privacy policies, cookies, fees, availability, security practices, support rules, payment rules, data-retention rules, and compliance obligations.

DietWings is not responsible for third-party services that are not controlled by DietWings, including their content, availability, decisions, errors, delays, security, data handling, payment processing, refunds, authentication, notifications, blockchain activity, food data, or professional advice.

You are responsible for complying with third-party terms when you use third-party services through or with DietWings.

DietWings processes personal information as described in our Privacy Policy, Cookie Policy, Data Processing page, and any applicable written agreement.

By using DietWings, you acknowledge that meal-planning inputs may include sensitive information, such as allergies, medical flags, body measurements, household profiles, nutrition goals, adherence records, AI chat messages, uploaded files, and information about other people.

You are responsible for ensuring that you have the required authority, notices, consents, permissions, and legal bases before submitting information about another person.

DietWings may use service providers and sub-processors to operate the service, including hosting, storage, AI functionality, authentication, payments, analytics, error monitoring, security, email delivery, Telegram notifications, support, and product operations.

DietWings may allow you to export certain meal plans, PDFs, shopping lists, account data, or other information through available product features.

Export features may not include every backup, log, derived record, analytics event, internal note, security event, audit record, provider record, payment-provider record, or administrative record.

You may be able to delete meal plans, restore deleted meal plans during an available restoration period, remove shared access, disconnect connected accounts, clear certain settings, schedule account deletion, or request account/data deletion through product settings or support.

Deletion is subject to product functionality, backup cycles, provider limitations, legal obligations, tax and accounting requirements, billing records, fraud prevention, abuse prevention, security needs, audit records, dispute handling, enforcement needs, and other retention grounds described in our Privacy Policy.

DietWings is not responsible for exported files, printed PDFs, screenshots, copied meal plans, shared links, downloaded data, or information saved outside DietWings after you export, print, share, or otherwise remove it from the service.

You may stop using DietWings at any time. You may cancel paid plans, delete certain data, disconnect integrations, remove shared users, or request account deletion through available features or support channels.

DietWings may suspend, restrict, downgrade, block, or terminate your access to all or part of the service if we reasonably believe that you violated these Terms, created risk, misused the service, failed to pay, abused trials or tokens, submitted harmful content, compromised security, violated law, infringed rights, triggered payment-provider restrictions, or used the service in a way that may harm DietWings, users, providers, payment systems, AI systems, or the public.

DietWings may also suspend or terminate access where required by law, sanctions rules, export-control rules, payment-provider rules, court order, regulator request, security incident, provider limitation, or discontinuation of the service.

After suspension or termination, you may lose access to your account, meal plans, AI chats, shopping lists, pantry data, exports, tokens, subscription features, connected accounts, shared access, and other product data.

Termination does not relieve you of payment obligations incurred before termination and does not limit DietWings’ right to retain information where permitted or required by law.

Sections that by their nature should survive termination will survive, including payment obligations, intellectual-property rights, user-content licenses, privacy and retention provisions, disclaimers, limitation of liability, indemnity, dispute provisions, and general legal terms.

You must not upload, submit, copy, distribute, or use content through DietWings unless you have the right to do so.

DietWings may remove or restrict content that we reasonably believe infringes intellectual property rights, violates law, violates these Terms, or creates risk.

If you believe content available through DietWings infringes your rights, contact [email protected] with enough information for us to review the issue.

DietWings names, logos, product names, page designs, icons, and branding may not be used without our prior written permission except where law permits nominative use.

You are responsible for complying with all laws and regulations that apply to your use of DietWings, including privacy, data protection, consumer protection, health, food, advertising, professional licensing, employment, tax, payment, sanctions, export-control, and intellectual-property laws.

You must not use DietWings from, in, or for the benefit of any country, region, person, organization, or entity where such use is prohibited by applicable sanctions, export-control rules, payment-provider restrictions, or other legal requirements.

DietWings may restrict features, accounts, payments, crypto-related payments, AI functionality, providers, integrations, subscriptions, tokens, or support in certain countries or for certain users where required by law, provider rules, compliance risk, or operational limitations.

To the maximum extent permitted by law, DietWings is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise.

DietWings does not guarantee health outcomes, weight loss, weight gain, muscle gain, fat loss, disease prevention, symptom improvement, allergy safety, medication compatibility, pregnancy suitability, child-nutrition suitability, improved lab results, improved athletic performance, improved adherence, budget savings, reduced food waste, or satisfaction with any plan.

DietWings does not guarantee that recipes, ingredients, nutrition estimates, budgets, grocery quantities, cooking times, food availability, pantry suggestions, leftovers suggestions, AI outputs, warnings, cautions, or shopping lists will be accurate, complete, safe, lawful, or suitable.

Some jurisdictions do not allow certain disclaimers. In those jurisdictions, the disclaimers apply only to the maximum extent permitted by law.

To the maximum extent permitted by law, DietWings and the DietWings parties will not be liable for indirect, incidental, consequential, special, exemplary, punitive, enhanced, or lost-profit damages, or for loss of data, loss of goodwill, business interruption, lost savings, substitute services, device compromise, payment-provider issues, provider outages, or loss arising from reliance on DietWings outputs.

To the maximum extent permitted by law, DietWings is not liable for harm arising from incorrect inputs, incomplete inputs, unauthorized third-party data submissions, unsafe reliance on AI output, ignored professional advice, ignored labels, allergy exposure, food-safety issues, medication interactions, shared-account misuse, user device compromise, user credential compromise, third-party service failures, payment-provider decisions, crypto-payment issues, blockchain activity, or actions taken outside DietWings systems.

To the maximum extent permitted by law, the total aggregate liability of DietWings and the DietWings parties for all claims arising out of or relating to the service or these Terms will not exceed the greater of the amount you paid to DietWings for the service giving rise to the claim during the twelve months before the event giving rise to liability or USD 100, or the equivalent in your billing currency.

These limitations apply to all theories of liability, including contract, tort, negligence, strict liability, warranty, statute, equity, and any other legal theory, even if a remedy fails its essential purpose or DietWings was advised of the possibility of damages.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by law, including liability for fraud, intentional misconduct, gross negligence, death or personal injury where exclusion is prohibited, mandatory consumer rights, or data protection rights that cannot lawfully be waived.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless DietWings and the DietWings parties from and against claims, damages, losses, liabilities, costs, fees, and expenses, including reasonable legal fees, arising from or related to your content, your inputs, your account, your misuse of DietWings, your violation of these Terms, your violation of law, your infringement of rights, your submission of third-party information without authority, your shared-access decisions, your use of outputs, your payment disputes, or your use of DietWings for professional, medical, clinical, regulated, commercial, or third-party purposes not permitted by these Terms.

DietWings may control the defense of any matter subject to indemnification, and you agree to cooperate with DietWings. You may not settle any claim in a way that imposes obligations on DietWings or admits fault by DietWings without our prior written consent.

This indemnity does not require you to indemnify DietWings for claims caused solely by DietWings’ own misconduct where such indemnity would be prohibited by law.

Nothing in these Terms limits rights that cannot lawfully be limited, including mandatory consumer, privacy, data protection, payment, digital-service, product-safety, or other statutory rights that may apply in your jurisdiction.

If you are a consumer, certain provisions of these Terms may apply only to the extent permitted by consumer law in your location.

If a provision of these Terms conflicts with a mandatory right that applies to you, the mandatory right controls, and the rest of these Terms remains in effect to the maximum extent permitted by law.

Before starting a formal dispute, you agree to contact [email protected] and give DietWings a reasonable opportunity to resolve the issue informally, unless applicable law allows you to proceed directly or the dispute is urgent.

These Terms are governed by the laws of Hungary, excluding conflict-of-law rules, except that mandatory consumer laws of your country or region may still apply where required.

Where permitted by law, the courts located in Budapest, Hungary will have exclusive jurisdiction over disputes arising from or relating to these Terms or DietWings.

If you are a consumer, this governing-law and venue section does not deprive you of mandatory rights to bring claims in your place of residence or to rely on mandatory consumer protections that apply in your location.

Where permitted by law, claims must be brought individually and not as a plaintiff or class member in any class, collective, consolidated, private attorney general, or representative proceeding. This paragraph does not apply where such waiver is prohibited by law or where mandatory law gives you a non-waivable right to participate in such a proceeding.

You agree that DietWings may send notices and communications electronically, including through the website, product, account area, email, billing portal, support channel, Telegram where connected, changelog, or other reasonable method.

Electronic notices satisfy any legal requirement that a notice be in writing, to the extent permitted by law.

You are responsible for keeping your email address and notification settings accurate and for reviewing service, account, security, billing, legal, and support messages.

DietWings is not responsible for missed notices caused by incorrect contact information, spam filters, email provider issues, Telegram settings, disabled notifications, or your failure to review messages.

DietWings may update these Terms from time to time to reflect changes in the service, AI features, providers, billing flows, security practices, legal requirements, business operations, or product functionality.

When changes are material, DietWings may provide notice through the website, product, account notice, email, changelog, billing notice, or another appropriate method.

The updated Terms become effective on the date stated in the updated version, unless a later date is required by law or stated in the notice.

Your continued use of DietWings after updated Terms take effect means you accept the updated Terms. If you do not agree, you must stop using DietWings and, where applicable, cancel paid features before further renewal.

The “Last updated” date shows when these Terms were last revised.

These Terms, together with the documents and checkout terms incorporated by reference, form the entire agreement between you and DietWings regarding the service, unless a separate signed agreement expressly states otherwise.

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions remain in effect, and the invalid provision will be interpreted or replaced to the maximum extent permitted by law to achieve its original purpose.

DietWings’ failure to enforce a provision is not a waiver of that provision or any other provision.

You may not assign or transfer your rights or obligations under these Terms without DietWings’ prior written consent. DietWings may assign or transfer these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, corporate transaction, change of control, or transfer of service operations.

DietWings is not liable for delay or failure to perform caused by events beyond its reasonable control, including provider outages, internet failures, labor disputes, natural disasters, war, terrorism, civil unrest, government action, payment-network issues, blockchain-network issues, AI-provider issues, security incidents, or legal restrictions.

There are no third-party beneficiaries to these Terms unless expressly stated.

If these Terms are translated, the English version controls to the extent permitted by law, unless mandatory law requires otherwise.
